In this Privacy Policy we describe the way in which Beata Celej owner of “MM System Diapers Beata Celej” (hereinafter: “Mommy Mouse” or “We”) processes your personal data in connection with your use of the services provided by Mommy Mouse through this website (the “Website”) and in connection with the services provided under the Regulations for the provision of services (the “Regulations“).

Mommy Mouse respects all data provided both actively and passively by persons visiting the Website users (“Users”) and Customers, and ensures proper protection of the collected data.

A.3. Changes to the Privacy Policy

Mommy Mouse may make changes to this Privacy Policy at any time, informing Users and Customers by posting the updated version of the Privacy Policy on the Website and informing Customers about it by sending the updated Privacy Policy to their e-mail addresses or by placing relevant information directly on the Account Customer, in the case of Customers who have an Account.

Therefore, we recommend that Customers and Users check the current version of the Privacy Policy from time to time. If the User / Customer does not accept changes to the Privacy Policy, he should refrain from using the Website.

A.4. Definitions

The terms used in this Privacy Policy should be understood as follows:

    • Personal data; This is all information about an identified or identifiable natural person.
    • An identifiable person; Is a person whose identity can be determined directly or indirectly, e.g. by reference to an identification number or a factor determining his physical, physiological, mental, economic, cultural or social characteristics.
    • Personal data processing; This is any operation on personal data, including collecting, recording, storing, processing, changing, sharing, deleting, copying.
    • Personal data administrator; This is an entity that sets the purposes and methods of processing personal data and who is responsible for their processing in accordance with the law. This Privacy Policy uses the definitions contained in the Regulations.

A.5. Legal regulations regarding privacy

The method of processing your personal data – in addition to the regulations and policies adopted by Mommy Mouse – is also specified in legal regulations, such as Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46 / EC (General Data Protection Regulation) the so-called GDPR.

B.1. Who is the administrator of my data?

  1. Mommy Mouse collects and processes personal data:
    – Consumers;
    – Customers running a sole proprietorship.
  2. Mommy Mouse may collect and process personal data when :
    – Subscribing to the newsletter;
    – Registering an individual Account on the Website;
    – Placing orders (including Users who do not have an Account on the Website);
    – Electronic or telephone contact;
    – Taking part in competitions;
    – Submitting complaints or inquiries about products sold by Mommy Mouse.
  3. Personal data collected and processed by Mommy Mouse includes:
    – Subscriptions to the newsletter;
    – Completion of the Account registration forms: email address, login to the Customer Account, password to the Customer Account, name and surname, address of residence, correspondence address, if different from the address of residence, telephone number;
    – Placement orders by Users who do not have an Account on the Website: name, surname, delivery address of the Order, e-mail address, telephone number, entering invoice data if it is requested, company name (optional).
    – Contact via electronic or telephone: contact details – such as name, surname, e-mail address, mobile phone number;
    – Participation in competitions: name, surname, prize delivery address, e-mail address, telephone number.

B.3. Is providing my data mandatory?

Providing data is voluntary, however, failure to provide data that is necessary, e.g. to set up an individual Account on the Website, perform the service or provide answers to queries and complaints may accordingly prevent Mommy Mouse from taking action or providing the appropriate functionality, service or information expected by the Customer, Consumer or User.

B.4. For what purposes and on what grounds is my data processed?

Your data is processed in accordance with the following legal grounds:

Personal data of Customers,

Consumers and Users placing orders without registering an Account on the Website may be processed by Mommy Mouse in order to perform and fulfill orders placed by the Customer in accordance with the Regulations, such as:

  1. Enabling the provision of electronic services and full use of the functionality of the Customer’s account, including making transactions and payments via the Customer’s account remotely;
  2. Setting up and managing a customer account and providing account support, transactions and technical problems resolution;
  3. The implementation of services included in the contract;
  4. Handling complaints for the provision of services by the operator of the payment platform in the event of a complaint by the customer;
  5. customer account service;
  6. contacting the client, including for purposes related to the provision of services;

Mommy Mouse may send information on the next stages of the contract on the Website to the e-mail address and telephone number of the Customer, Consumer, User.

Data processing for the implementation of services provided by Mommy Mouse ordered by the Customer, Consumer, User in accordance with the Regulations is lawful, because it is necessary to perform the contract with a given person, e.g. to provide a service.

As part of the functionality of an individual Account, the Customer may have access to e.g. order history, purchases.

Personal data of Customers and Users may be processed to respond to complaints regarding the Website, orders (warranty, guarantee), products, for tax and accounting purposes.

Data processing is lawful because it is necessary for the purposes arising from applicable legal provisions (e.g. Act on Consumer Rights, Civil Code, Tax Code)

Legitimate interest of Mommy Mouse [art. 6 clause 1 lit. f) GDPR] Users’ personal data (e.g. if they ordered the newsletter) and Customers can be processed by Mommy Mouse also for the following purposes:

  1. monitoring the activity of customers, consumers and all other users (guests);
  2. matching ads in line with the content previously viewed by the Customer, Consumer, User;
  3. contacting Customers, Consumers, Users, including for purposes related to permitted marketing activities, through available communication channels, in particular and with the consent of the Customer – by e-mail and telephone;
  4. support and provision of payment services;
  5. ensuring the security of services that are provided to Customers, Consumers, Users electronically, including counteracting fraud and abuse;
  6. monitoring the activity of Customers, Consumers and all other users (guests), e.g. keyword search,
  7. conducting research and analyzes,  in terms of the functionality of the Customer Account, improving the performance of services or estimating the main interests and needs of visitors;
  8. handling requests and entitlements of clients provided in particular when they are not directly related to the performance of the contract;

  9. organization of loyalty programs, competitions and promotional campaigns in which Customers, Consumers, Users may participate;

  10. debt collection; conducting court, arbitration and mediation proceedings; 

  11. conducting statistical analyzes;

  12. storing data for archiving purposes and ensuring accountability (demonstrating compliance with obligations arising from legal provisions);

  13. providing information on the company’s activities, recent events, current offer and promotions.;

The processing of data for these purposes is lawful because it is necessary for the purposes of the legitimate interests pursued by Mommy Mouse.

The legitimate interest of Mommy Mouse is to process Customer and User data in order to adapt the content of the website to Users’ preferences, to inform about current services, promotions, contests, contacting Clients, Consumers, Users in response to queries

Your consent [art. 6 clause 1 lit. a) GDPR]

The User (e.g. via the Website) and the Customer, Consumer (e.g. during registration of an individual Account) may be able to consent:

  1. for sending commercial information by e-mail, e.g. a newsletter;
  2. telephone marketing;
  3. making automated decisions based on profiling (e.g. to automatically adapt offers and discounts to a specific user);
  4. contacting, collecting opinions and presenting the offer after product delivery;
  5. save data in cookies, collect data from websites and mobile applications;

Consent is not a requirement for using the Mommy Mouse Services. Consent may be withdrawn at any time, e.g. through the Account settings in the Account panel or by clicking on the link contained in the email received containing marketing content. Withdrawal of consent does not affect the processing of data (or the lawfulness of this processing) before the withdrawal of consent (e.g. sending commercial information and telephone marketing that took place before its withdrawal).

Determination, investigation or defense of claims [art. 6 clause 1 lit. f) GDPR]

Personal data of Customers,

Consumers, Users may be processed in order to:

  1. determining the claim before the court;
  2. seeking payment for ordered goods or services before a court;
  3. recovery of claims based on orders or services;
  4. defend their rights in the event of a court case by the Customer, Consumer or User;
Personal data of Clients, Consumers, Users may be processed in order to determine, assert or defend claims arising from concluded contracts, orders placed and services rendered.

 

B.5. How long is my data stored?

Your data will be stored for the following periods:

B.6. Where is my personal data processed?

Customers ‘and Users’ personal data are processed and stored in the European Economic Area. Personal data will be transferred outside the European Economic Area to Google LLC based on appropriate legal safeguards, which are standard contractual clauses for the protection of personal data, approved by the European Commission.

B.7. Who is my data shared with?

In addition, in order to provide services ordered in accordance with the Regulations, personal data of Customers may be transferred to the necessary extent to third parties performing the delivery of orders and supporting us in the conclusion and performance of contracts, as well as in the investigation or defense against claims, while performing obligations arising from legal provisions, supporting us in the provision of marketing services, including in particular: entities providing advisory, consulting, auditing, legal, tax, accounting assistance, research agencies acting on our behalf, Poczta Polska, courier companies, IT service providers, marketing agencies of courier companies, as well as to entities cooperating with Mommy Mouse, e.g. providing services ordered by the Customer.

With the consent expressed by the User, his personal data may be shared with entities related to us and our business partners in order to conduct direct marketing of products and services of these entities.

B.8. Are my decisions based on my personal data affect me automatically?

Customers’ personal data may be used to make decisions that are based solely on automated processing, including profiling, and have legal effects on customers or similarly significantly affect customers.

If the Customer has agreed otherwise, we will automatically adapt the appropriate content to the Customer’s profile, e.g. offers and discounts based on profiling. Automated decisions will be made on the basis of, among others for previous customer purchasing decisions, age, gender, etc. This will allow us to better tailor the offer to customer needs.

YOUR RIGHTS

In the event that the law so provides and on the principles set out therein, the Customer and the User have specific rights related to personal data, which are described in detail below. Some of these rights, ire. the right to access, correct and delete data, can be exercised directly by the Customer in the individual Account panel set up by the Customer.

C.1. How can I exercise my rights?

You can make a specific request to us using the contact details in the Contact tab. After receiving your request and possible verification of your identity, we will take appropriate action on your request.

By law, you will receive an appropriate response from us as soon as possible, but (in principle) within a month. In a situation where your request is extremely complicated or you ask us to fulfill many requests at the same time, this period may be extended by a maximum of another two months. In this case, you will be notified of such an extension.

Answers to your questions and communication with you and our actions related to your requests are (in principle) free of charge..

C.2. Right of access

You have the right to access your personal data. You can contact Mommy Mouse with questions about:

  • confirmation that we are processing your personal data;
  • the purposes of processing your personal data;
  • the categories of your personal data;
  • information about the recipients of your personal data;
  • information about the planned period of storage of your personal data (or criteria for determining it);
  • information about your rights related to your personal data;
  • information about the sources of your personal data in situations where they have not been collected from you;
  • information about automated decision making regarding you based on the processing of your personal data, including profiling.

You can also ask us for a copy of your personal data being processed. Further copies may be charged.

C.3. Rights related to data processing

In connection with the processing of your personal data, you have the following rights:

  • when we do not need personal data but you need it to establish, pursue or defend claims;
  • your opposition (for more information on opposition in section C.5).

“Blocking” your data is that Mommy Mouse will still be able to store your personal data, but we will not be able to process (use) it in any other way, except in special situations (e.g. when it is required by an important public interest).

Right to data portability

You have the right to request Mommy Mouse to release your personal data in a structured, commonly used machine-readable format. You have the right to send this data to another data administrator. You also have the right to request Mommy Mouse to send this data to another data administrator if it is technically possible. The right to transfer personal data applies only to situations in which your data is processed:

  • on the basis of your consent or on the basis of a contract (e.g. when data is processed as part of a product order); and
  • in an automated manner.

You have the right to request the deletion of your personal data in some cases, including if:

  • Your data is processed unlawfully;
  • they are no longer necessary to achieve the purposes for which they were collected or processed;
  • there is no legal basis for their processing (e.g. when you withdrew your consent or objected, and there is no other basis for data processing);

Your right to request the deletion of your personal data may be limited in some cases, including when their processing is necessary to fulfill the legal obligations of Mommy Mouse (e.g. in accordance with the obligations related to keeping the books of account). 

 

C.4. The right to withdraw consent

You have the right to withdraw your consent at any time, e.g. through the Account settings in the Account panel or by clicking on the link contained in the email that contains marketing content. In order to withdraw your consent, you can also contact us using the contact details in the Contact tab.

Warning! Withdrawal of consent may lead to the fact that Mommy Mouse will not be able to provide you with services based on your consent.

Withdrawal of consent does not affect the lawfulness of the processing that was carried out on its basis before its withdrawal.

C.5. Right to object

You have the right to object to the processing of your personal data if such processing is based on the legitimate interest of Mommy Mouse (for more information on the concept of legitimate interest in point B.4.).

You can object to reasons related to your particular situation. If you object to:

  • processing of personal data for direct marketing purposes – Mommy Mouse will not be able to process your personal data;

  • processing personal data for other purposes – Mommy Mouse will not be able to process your personal data, unless there are legitimate and legally valid grounds for processing that override your interests, rights and freedoms, or the grounds for establishing, investigating or defending claims.

The right to object concerns only the processing of personal data on the basis of the legitimate interest of Mommy Mouse and it does not apply to the processing of your personal data based on the performance of the contract, your consent or other legal grounds (for more information on the legal grounds for processing in point B.4.).

COOKIES

D.1. What are cookies?

Cookie files (so-called “cookies”) are IT data, in particular text files, which are stored in the Website User’s and Customer’s end device and are intended for using the Website’s pages (e.g. on the hard disk of a computer, laptop or smartphone memory card – depending on which device the User uses). Cookies usually contain the name of the website from which they originate, their storage time on the end device and a unique number.

D.2. For what purpose does the Website use cookies?

Mommy Mouse uses cookies for the following purposes:

  • adapt the content of the Website pages to the User’s and Customer’s preferences and optimize the use of websites; in particular, these files allow to recognize the device of the Website User and the Customer and properly display the website, tailored to his individual needs;
  • creating statistics that help to understand how Website Users and Customers use websites, which allows improving their structure and content;
  • maintaining the client’s session (after logging in), thanks to which the client does not have to re-enter the login and password on each sub page of the Website;
  • maintaining information about products added by the customer to the “basket”.

D.3. What cookies are used by the Website?

On the www.wholesale.mommymouse.com.pl website we use our own session and permanent cookies. First-party cookies are used to:

  • maintain the User’s basket and session;
  • remember the language version and delivery address;
  • remember the reference code (where the customer came from);
  • remember the data entered in the order form – the form of delivery and payment, delivery address and invoice address;
  • remember User’s preferences, e.g. sorting settings, showing them again messages, etc.

We also use external cookies from entities with whom we cooperate, such as Google, Facebook.

Due to the fact that the operation of some cookies from external partners may be different than presented in this policy and we cannot control cookies placed by websites belonging to third parties, please read the information on these cookies available on websites of our partners, e.g.

We also use Tracking pixel (aka web bug), which performs similar functions as cookies, but are unrecognizable to the user. Tracking pixels are used by us to measure the User’s behavior on the site, to send the newsletter, to match offers in advertising.

The data is anonymous and is not associated with personal data on the User’s end device or any database. To disable the web bug when using our website, you can use e.g. tools such as web washer, bugnosys or AdBlock (for Firefox). To disable the web bug in the newsletter, you need to change your email program settings so that it does not display the message in html. The web bug also doesn’t work when messages are read offline.

D.4. How can I manage my consent to the use of cookies?

Software used for browsing websites (web browser) by default allows the storage of cookies on the User’s and Customer’s terminal equipment. Website Users and Customers can change cookie settings at any time. These settings can be changed in particular in such a way as to block the automatic handling of cookies in the web browser settings or to inform about them every time they are entered in the device of the Website User and Customer. Detailed information about the possibilities and ways of handling cookies is available in the software (web browser) settings.

Warning! Withdrawing your consent to the use of cookies may limit some of the Website’s functionalities, including no “remember” option:

  • Purchases in your basket;
  • Your passwords and logins;
  • Your language settings;
  • Your time zone;
  • Your preferences for screen resolution;
